Close collaboration with many government agencies and public corporate bodies over the years, has given us a clear understanding of the focus and needs of the public sector.

We handle a myriad of public real estate transactions such as those between public and private stakeholders including office buildings hosting public services, housing, day-care centres, schools, cultural centres, police stations and more. Of particular note is our focus on PPP (DBFM(O)) contracts, public real estate contracts, public IT contracts, concessions (utilities, including waste and transport), public service concessions and utilities.

We handle these matters for a broad range of clients composed of federal and regional state authorities, local authorities, public undertakings, and companies in the public utilities sectors. Our clients also include many private companies with a need for assistance in the public sector.

Our firm’s multidisciplinary approach ensures all the necessary fields of expertise are in house such as constitutional law, public law, procedural administrative law, procurement law, public financing, real estate and construction (including PPP/PFI aspects), tax and competition.

Furthermore, we support both public authorities and private companies in the context of disputes brought before the courts, the Council of State (Conseil d’État/Raad van State) or the Constitutional court.

Dutch Supreme Court clarifies evidentiary rules concerning signatures and signed documents

Short Reads - In two recent decisions, the Dutch Supreme Court has clarified the evidentiary power of signed documents. If the signatory unambiguously denies that the signature on the document is his or hers or claims that another party has tampered with the signature (for instance, through forgery or copying a signature from one document and pasting it in another), it is up to the party invoking the signed document to prove the signature's authenticity (ECLI:NL:HR:2019:572).

De Codextrein: een hobbelig parcours

Articles - De zgn. 'Codextrein' (het decreet van 8 december 2017 houdende wijziging van diverse bepalingen inzake ruimtelijke ordening, milieu en omgeving)  deed al heel wat stof opwaaien. Niet in het minst omdat het onder meer de (administratieve) beroepsmogelijkheid voor het "betrokken publiek" ernstig beperkt. Niet geheel verwonderlijk trokken een aantal actiegroepen naar het Grondwettelijk Hof om de grondwettigheid van deze beperking in vraag te stellen. Bij arrest dd. 14 maart 2019 heeft het Grondwettelijk Hof deze beperking vernietigd. Hierna wat duiding.

One year of GDPR - The regulatory warm-up

Short Reads - The first year of the General Data Protection Regulation ("GDPR") is over. Although early noises predicted an entirely new data protection regime, the European legal framework did not change substantially, the major changes being an expansion of the territorial scope to non-EU countries and stronger powers of enforcement. In spite of fears and rumours of immediate enforcement and huge fines, most regulators focused on helping companies achieve compliance, or they enforced without directly imposing fines.

Europees milieurecht: wat na 26 mei?

Articles - Het domein van milieurecht kent een sterke Europeesrechtelijke inslag. Voor basisregels inzake natuurbescherming, luchtkwaliteit of klimaat, ligt het juridisch zwaartepunt al lang niet meer bij de lidstaten. Reden te meer om in de gaten te houden wat er op EU-niveau in de pijplijn zit en op lidstaten afkomt. Ook na de Europese verkiezingen zal de nieuwe Europese Commissie verschillende initiatieven nemen. Zowel impliciet als expliciet lichtten de Commissie en haar vertegenwoordigers de voorbije maanden al een tipje van de sluier op.
