Vordering tot een verklaring voor recht dat aansprakelijkheid bestaat. De rechter dient bij de beoordeling van een dergelijke vordering ervan uit te gaan dat eiser daarbij belang heeft als de mogelijkheid van schade aannemelijk is. Dat geldt ook als niet tevens een veroordeling tot schadevergoeding of tot verwijzing naar de schadestaatprocedure wordt gevorderd. De Hoge Raad komt in zoverre expliciet terug van eerdere jurisprudentie. Van een veroordeling door de strafrechter levert slechts de bewezenverklaring dwingend bewijs op in een civiele procedure (art. 161 Rv).
