Offering full-service legal advice, our energy team works hand-in-hand with other specialisms within our firm. They have worked with the construction and planning and environment team on various onshore and offshore wind projects; with the finance team on project financing of independent project; and alongside the corporate team, on setting up SPV and fund structures for independent power projects.

We have experience in all areas of law relevant to energy projects, such as onshore and offshore wind projects, solar projects, biomass and CHP power plants, and the placing of power cables and pipelines.

Second Belgian Offshore Wind Farm Area to be tendered

Articles - At the Council of Ministers session on 31 August 2018, the principle memorandum Tendering offshore wind farms from 2020 onwards was approved. This memorandum sets out the actions and timing for the new area for offshore wind farm (1.7 GW). Very similar to what has happened in the Netherlands, the right to construct and operate new wind farms will be tendered in hope of not having to grant any subsidies at all.

Key changes for renewables under the CEP

Articles - On 21 December 2018 a substantial part of the long-awaited Clean Energy Package ("CEP") was published in the Official Journal, notably the recast Renewable Energy Directive (EU) 2018/2001 (the “recast RED”), the Energy Efficiency Directive 2018/2002 as well as the new Energy Union and Climate Action Governance Regulation (EU) 2018/1999. This legislation enters into force on 24 December 2018; the directives have to be implemented by 30 June 2021 resp. 25 June 2020. In this communication, which is not binding from a legal perspective but reflects the EU Commission’s view on this topic, the EU Commission confirms, among others, that the Energy Charter Treaty (ECT) arbitration mechanism cannot be applied in a dispute between an EU investor and an EU Member State.

Articles - A la suite de la réforme du CoBAT intervenue par l’ordonnance du 30 novembre 2017, le Gouvernement bruxellois a adopté, le 3 mai 2018 plusieurs mesures réglementaires indispensables à la mise en œuvre des « plans d’aménagement directeurs » (PAD). Le Ministre-Président a, pour sa part, donné, le 8 mai 2018, pour instruction à Perspective.brussels (bureau bruxellois de la planification) d’entamer le travail d’élaboration des projets de PAD pour plusieurs pôles stratégiques de la Région de Bruxelles-Capitale (Mediapark, Loi, anciennes casernes d’Ixelles, etc).
