Offering full-service legal advice, our energy team works hand-in-hand with other specialisms within our firm. They have worked with the construction and planning and environment team on various onshore and offshore wind projects; with the finance team on project financing of independent project; and alongside the corporate team, on setting up SPV and fund structures for independent power projects.

Short Reads - Legislative background On 22 December 2015, the Dutch Senate rejected the legislative proposal "STROOM", which included provisions to effectuate the Dutch Energy Agreement (Energieakkoord), by the narrowest of margins. Subsequently, a substantively similar legislative proposal, the Energy Transition Act (wet VET) was tabled and then shelved, as it was declared "controversial" by the Dutch House of Representatives, meaning that debate on the proposal was postponed until the new Dutch government was in office.

L’arrêté wallon portant conditions sectorielles des parcs d'éoliennes a été annulé par le Conseil d’Etat!

Articles - Trois ans et demi après avoir fait l’objet d’un recours en annulation et après un détour préjudiciel à la Cour de Justice de l’Union européenne, le Conseil d’Etat a finalement annulé l’arrêté wallon fixant les conditions sectorielles s’appliquant aux parcs éoliens. Cette décision ne créera cependant pas le séisme annoncé. Le Conseil d’Etat a, en effet, décidé de maintenir définitivement les effets de l'arrêté tant pour le passé que pendant les trois prochaines années.

Energy Charter Treaty arbitration clause cannot be relied on in intra-EU investment disputes, says EC

Articles - Following the Achmea judgement of the CJEU, the European Commission issued a new document providing guidance on the protection of cross-border EU investments. In this communication, which is not binding from a legal perspective but reflects the EU Commission’s view on this topic, the EU Commission confirms, among others, that the Energy Charter Treaty (ECT) arbitration mechanism cannot be applied in a dispute between an EU investor and an EU Member State.

Articles - A la suite de la réforme du CoBAT intervenue par l’ordonnance du 30 novembre 2017, le Gouvernement bruxellois a adopté, le 3 mai 2018 plusieurs mesures réglementaires indispensables à la mise en œuvre des « plans d’aménagement directeurs » (PAD). Le Ministre-Président a, pour sa part, donné, le 8 mai 2018, pour instruction à Perspective.brussels (bureau bruxellois de la planification) d’entamer le travail d’élaboration des projets de PAD pour plusieurs pôles stratégiques de la Région de Bruxelles-Capitale (Mediapark, Loi, anciennes casernes d’Ixelles, etc).

Dutch Government announces termination of natural gas extraction in Groningen

Short Reads - In a letter to the Dutch House of Representatives dated 29 March 2018, Minister Wiebes of the Ministry of Economic Affairs and Climate announced that natural gas extraction from the Groningen gas field will be terminated entirely in the coming years. No later than 2022 and possibly one year sooner, the natural gas extraction level will be reduced to below 12 billion Nm3. In subsequent years, it will gradually be reduced to zero.
