We regularly act for large industrial and chemical companies on a wide variety of matters including M&A transactions, project development, operational issues, commercial contracting, and pipeline and transport issues.

In addition, we have proven expertise in advising our clients on registration queries and obligations under WEEE and waste directives, the application of the Environmental Liability Directive, complex litigation on REACH, CLP matters and client obligations for labelling and packaging of products containing certain substances.

Dutch Supreme Court clarifies evidentiary rules concerning signatures and signed documents

Short Reads - In two recent decisions, the Dutch Supreme Court has clarified the evidentiary power of signed documents. If the signatory unambiguously denies that the signature on the document is his or hers or claims that another party has tampered with the signature (for instance, through forgery or copying a signature from one document and pasting it in another), it is up to the party invoking the signed document to prove the signature's authenticity (ECLI:NL:HR:2019:572).

EU Single-Use Plastics Directive is now in force: brief recap

Articles - Plastic is a significant and growing global concern. A recent study commissioned by WWF and carried out by the University of Newcastle, Australia, suggests that people are consuming around 2,000 tiny pieces of plastic every week (which is approximately 5 grams of plastic, the weight of a credit card).  In this context, the EU adopted a new directive aiming at tackling marine litter generated from 10 single-use plastic products and from abandoned fishing gear and oxo-degradable plastics. This is called the Single-Use Plastics Directive and has entered into force this month, on 2 July 2019.

Although early noises predicted an entirely new data protection regime, the European legal framework did not change substantially, the major changes being an expansion of the territorial scope to non-EU countries and stronger powers of enforcement. Articles - Bij arrest van 25 juni 2019 (C-723/17) deed het Hof van Justitie uitspraak over enkele prejudiciële vragen, voorgelegd door de Nederlandstalige rechtbank van eerste aanleg Brussel, over de toepassing van de Europese Luchtkwaliteitsrichtlijn (2008/50/EG). Het Hof kent in zijn arrest de nationale rechter een belangrijke taak toe bij de correcte implementatie en afdwinging van de Luchtkwaliteitsrichtlijn.

Europees milieurecht: wat na 26 mei?

Articles - Het domein van milieurecht kent een sterke Europeesrechtelijke inslag. Voor basisregels inzake natuurbescherming, luchtkwaliteit of klimaat, ligt het juridisch zwaartepunt al lang niet meer bij de lidstaten. Reden te meer om in de gaten te houden wat er op EU-niveau in de pijplijn zit en op lidstaten afkomt. Ook na de Europese verkiezingen zal de nieuwe Europese Commissie verschillende initiatieven nemen. Zowel impliciet als expliciet lichtten de Commissie en haar vertegenwoordigers de voorbije maanden al een tipje van de sluier op.

REACH 2.0: eenvoudiger maar meer controles?

Articles - Op 5 maart 2018 publiceerde de Europese Commissie haar bevindingen van de tweede REFIT evaluatie van de REACH-verordening. Al bij al zijn de resultaten positief. Toch is er ruimte voor verdere verbetering, vereenvoudiging en lastenverlichting. Deze REFIT-suggesties worden volop in de praktijk gebracht. Voorts is een nieuwe Europese dienst, EUCLEF, in de maak. Deze gegevensdienstverlener zal via licentieverlening gegevens leveren inzake de manier waarop chemische stoffen gereguleerd zijn op Europees niveau.
