The impact of Book 7 and the Data Act on IT contracts

This seminar, the second in our 2025 TMT seminar series, covers the impact of Book 7 (Special Contracts) and the Data Act on IT contracts. It will be led by Frederik Van den Abeele, lawyer in our Real Estate & Construction practice group and contributor to the commission responsible for drafting Book 7, and Carolien Michielsen, lawyer in our TMT practice group who has extensive experience with IT contracts.

 

Today, every organisation regularly encounters IT contracts, ranging from software licensing, the integration of (customised) software packages, to cloud services and data centre agreements, and more. In this seminar, our multidisciplinary team will guide you through recent legal developments that impact such IT contracts. We will:

  • Discuss the key developments in the draft bill introducing Book 7 (Special Contracts) into the new Civil Code.
  • Zoom in on how these developments under Book 7 impact IT contracts, by sharing specific examples and practical takeaways to help you understand the implications.
  • Examine the implications of the EU Data Act, applicable since 12 September 2025, with a focus on terms that are considered unfair in IT contracts and requirements for data sharing agreements.
