Stibbe successfully represents Smurfit Westrock and achieves partial annulment of the zero-emission zone in Eindhoven

Stibbe successfully represented Smurfit Westrock Recycling B.V. in proceedings before the District Court of Oost-Brabant concerning the introduction and expansion of a zero-emission zone in the municipality of Eindhoven. The court ruled that the decision to establish a zero-emission zone was not properly prepared and motivated with regard to the weighing of interests in relation to “De Kade”, the industrial site located within the Eindhoven ring road, the boundaries chosen for the zero-emission zone. The court ruled that the (traffic) decision cannot be sustained insofar as it concerns the industrial site “De Kade”. The relevant part of the decision that would have resulted in Smurfit Westrock Recycling B.V. falling within the zero-emission zone has now been annulled.
