This seminar, the first in our 2025 TMT seminar series, examines the new Belgian Private Investigation Act ("Wet tot regeling van de private opsporing" / "Loi réglementant la recherche privée"), which came into effect in December 2024. This legislative reform brings a fundamental overhaul of the legal framework governing private investigations in Belgium, with significant implications for both external investigators and internal corporate investigation services.

 

Our multidisciplinary team, combining expertise in labour law, criminal law, and data/privacy law, will provide a practical overview of the Act's scope, key principles, and legal obligations, including the necessity for a documented legitimate interest, mandatory internal policies, and procedural safeguards such as interviewee rights and data protection measures.
 

Next to this general overview, we will provide hands-on advice on the interplay between this new act and three specific sectors: labour law, data and privacy law and criminal law. Our team will be joined by a special guest speaker who will share insights from the field, helping to make the new Act tangible for your organisation.
