Le tribunal d’entreprise de Gand a jugé que l'utilisation de secrets d’affaires obtenus de façon illicite lorsqu’on savait/aurait dû savoir qu'ils avaient été obtenus illicitement, viole l'article XI.332/4 du CDE et est contraire à la concurrence loyale.

La Cour de Cassation a confirmé que même si les infractions liées aux pratiques de marché loyales relèvent de la responsabilité extracontractuelle, le juge des cessations est compétent pour se prononcer sur l’existence d’une rupture de contrat.
