Stibbe advises RWE on the acquisition from Vattenfall of the state-of-the-art gas-fired power plant Magnum with a capacity of 1.4 gigawatt and a 5.6 megawatts solar plant at Eemshaven, the Netherlands. RWE is active in electricity generation from renewable and conventional energy sources and energy trading. On 21 December 2022, the European Commission concluded that the proposed acquisition would raise no competition concerns, given (i) the limited combined market position resulting from the proposed transaction; (ii) the presence of large competitors in the Netherlands; and (iii) the lack of incentives to engage in particular anticompetitive strategies.
