Masterclass: chain liability in the construction industry

On 11 June 2019 in Amsterdam, Stibbe will host a Masterclass titled 'Chain liability in the construction industry: the labour law, administrative law and tax law issues'. During this Masterclass, we will focus on all the various types of chain liability in the Netherlands.

Construction sites are complex and dynamic workplaces where multiple companies often perform work together. Contractors often outsource part of their work to subcontractors, who in turn can outsource part of their work to subsequent subcontractors, and so on.

The Labour Inspectorate works closely with the Tax and Customs Administration (Belastingdienst) to monitor compliance with laws and regulations, and regularly visits new and existing construction sites for this purpose. If it turns out that one of the parties involved does not comply with the laws and regulations, there is a risk that each link in the chain - under certain circumstances, this can also include the client - may be liable or co-liable for all subsequent links. Examples include joint and several liability for underpaid wages or unpaid payroll taxes, and administrative liability for the payment of administrative fines under the Foreign Nationals (Employment) and Accidents at Work Act (Wet arbeid vreemdelingen en arbeidsongevallen).

The Masterclass will be presented by Johan Vrolijk, tax and social security expert, Johan Zwemmer, employment law expert, and Christien Saris, compliance, supervision and enforcement expert.  The Masterclass will feature analysis of the following questions:

  • What are the key points of attention from an employment, administrative and tax law perspective?
  • Can a client be held liable for noncompliance with laws and regulations by contractors or subcontractors?
  • Can penalties and sanctions be laid down in a contract?
  • How can the risk of being held liable be limited as much as possible?
