We are pleased to announce that Stibbe Amsterdam has promoted Valérie van ‘t Lam, Boris Cammelbeeck and Roderik Vrolijk to partner as per 1 January 2022. These appointments further strengthen our practices Environment & Planning, Real Estate and the Financial Markets Group. Stibbe Amsterdam will grow to 44 partners.

Our clients are increasingly confronted with complex environmental law matters. Valérie van ‘t Lam acts at the forefront of these matters as part of our leading Environment & Planning practice and as editor of various leading Dutch environmental law magazines.

Specialising in environmental law, she primarily focuses on climate, energy transition, circular economy, the new Environment and Planning Act (Omgevingswet), and supervision and enforcement. She acts for businesses, developers and public bodies, representing them before Dutch and European courts, the legislator and in negotiations with government agencies and other public authorities.

She is an expert in her field and an example for many of our younger colleagues. Above all, she has demonstrated her ability to go above and beyond for her clients. Boris Cammelbeeck is part of Stibbe’s Real Estate practice and co-heads the Real Estate Transaction Group. Boris has contributed to the rapid development of Stibbe’s Real Estate Transaction Group and its expanding client base.

Being a specialist in large-scale real estate transactions, Boris advises on the purchase, sale and financing of real estate. He also advises clients on all aspects of their corporate real estate and on matters involving project development and real estate contracts concerning commercial and residential properties.  He acts on behalf of corporates, real estate companies, project developers,  investors, banks, global retailers and municipalities.

Roderik Vrolijk is part of Stibbe’s Financial Markets Group and has extensive experience in the field of financial regulation. He advises financial institutions on securities law and financial supervision law, and a broader portfolio of clients on the application and impact of financial regulatory law including Solvency II, MiFID II, PSD2 and DORA. In addition, Roderik assists clients with respect to the development of innovative financial products and services, and advises on questions relating to market entry in a rapidly changing regulatory landscape. He draws on his years of experience in dealings with Dutch and EU financial regulators.

Supreme Court clarifies rent reductions for catering and retail businesses during corona period

Short Reads - On 24 December 2021, the Supreme Court ruled on the preliminary questions of the District Court of Limburg. In these preliminary ruling proceedings, the key question was – in brief – whether tenants of business premises as referred to in Section 7:290 of the Dutch Civil Code (such as hotels, restaurants, cafes and shops) are entitled to a rent reduction as a result of government measures in connection with the corona pandemic and, if so, how that rent reduction should be calculated.

FAQ: Consequences of the Didam judgment for the sale of land by governments

Short Reads - In the Didam judgment of 26 November 2021 (ECLI:NL:HR:2021:1778) the Supreme Court ruled that public authorities must sell land in a transparent manner that gives all interested parties the opportunity to bid. This means that public authorities are not outright free to sell land to a party of their choice. Public authorities must provide equal opportunities when transferring land.

Hoge Raad schept duidelijkheid over huurkortingen in coronatijd voor horeca en winkeliers

Short Reads - Op 24 december 2021 heeft de Hoge Raad uitspraak gedaan naar aanleiding van de prejudiciële vragen van de rechtbank Limburg. In deze prejudiciële procedure stond – kort gezegd – de vraag centraal of huurders van 290-bedrijfsruimten (zoals bijvoorbeeld hotels, restaurants, cafés en winkels) als gevolg van overheidsmaatregelen in verband met de coronapandemie aanspraak kunnen maken op vermindering van de huurprijs, en zo ja hoe die vermindering moet worden berekend.

FAQ: Gevolgen van het Didam-arrest voor de verkoop van onroerende zaken door overheden

Short Reads - In het 'Didam'-arrest van 26 november 2021 (ECLI:NL:HR:2021:1778) heeft de Hoge Raad geoordeeld dat overheden bij de verkoop van grond gelegenheid moeten bieden aan (potentiële) gegadigden om mee te dingen. Dat betekent dat overheden niet zonder meer vrij zijn om grond te verkopen aan een partij naar keuze. Overheden moeten gelijke kansen bieden bij uitgifte van grond.
