Stibbe represented HEMA’s management board in summary proceedings brought by a noteholder seeking to block the implementation of HEMA’s envisaged restructuring.
The envisaged restructuring should reduce HEMA’s gross debt to €300m from €750m, and should also result in the existing shareholder structure being replaced, and the holders of the existing senior secured noteholders becoming the new shareholders. The Amsterdam District Court dismissed all claims brought by the noteholder.
