On Tuesday 24 November 2020, Liesbeth Berkouwer and Annalies Outhuijse will host a webinar on the theme of ‘the Quality Assurance Act for Construction in the Building sector’ (Wet kwaliteitsborging voor het bouwen (Wkb)).

On 1 January 2022, the Netherlands will switch to a new system of building supervision under the Wkb. The most important adjustment is that aspects such as safety, usability, and energy efficiency of buildings will no longer be assessed by the competent municipality authority, but by market parties. The new system presents parties with dilemmas from an administrative law perspective.

In the webinar on 24 November, we will - together with Wico Ankersmit (general director of the Construction and Housing Supervision Association) - specifically address various legal bottlenecks on the basis of the 3 construction phases (before, during and after construction). Among others, the following questions will be discussed:

  • What is the role of the competent authority during these 3 phases?
  • What assessment is expected from the competent authority prior to and after the construction work?
  • Is the competent authority able to effectively carry out its supervisory and enforcement task in the new system?
  • What if the competent authority sees risks that have not been noticed by the market parties?
