In this era of digitisation, data is often called the 'new gold' or 'oil'.  In our aim to gain more insights that will lead us to higher revenue, new market opportunities or new regions, we are analysing data at full throttle. But it needs to be handled with care, using a data architecture that follows your general strategy while ensuring solid security, quality, etc.

This session is organised by Beltug, the largest Belgian association of Digital Technology Leaders, and takes place in Grimbergen on 18 March 2020.

Companies will share their real-life experiences and best practices: Borealis will set the scene with challenges; Brussels Airport Company, AXA Bank and publiq will share their vision on data governance; and Stibbe will get into the legal perspective for non-personal, i.e. 'industrial', data.

Erik Valgaeren, head of the TMT and data governance practice in our Brussels office, will set the stage for an audience discussion on the legal perspective on industrial data. ‘Data' is not an existing category in our legal system, making it difficult to qualify from a legal perspective, or to identify rights and obligations. The GDPR only provides direction, and only for 'personal data'. But what about non-personal, or 'industrial data'? Who owns the data in your systems? What are the rights and obligations of the data creator? What boundaries should you respect when engaging in data mining and data analytics? How do contracts come into play and what should a proper data governance cater for?

De hoop bestond dat de Afdeling antwoord zou geven op de vraag of de AP terecht of onterecht meent dat een zuiver commercieel belang géén gerechtvaardigd belang kan zijn in de zin van de Algemene Verordening Gegevensbescherming. Het antwoord op deze vraag blijft echter uit.

Purely commercial interest also a legitimate interest? Council of State leaves the question unanswered.

Short Reads - On 27 July 2022, the Council of State confirmed that the Dutch Data Protection Authority wrongly imposed a €575,000 fine on VoetbalTV. But the Council did not answer the question whether the AP rightly or wrongly believes that a purely commercial interest cannot be a legitimate interest within the meaning of the General Data Protection Regulation.
