Stibbe has represented the court-appointed administrators in the bankruptcy of Amsterdam hospital MC Slotervaart in proceedings against the City of Amsterdam, centred on the City’s demand that the administrators investigate whether there were any irregularities prior to the bankruptcy.
The administrators claimed that such an investigation is neither required nor appropriate as MC Slotervaart has offered a plan of composition to its creditors, with financing from Zadelhoff, under which it will pay 100% to its creditors. This plan would be endangered by lengthy investigations. In its 10 July 2019 judgment, the Amsterdam District Court ruled in favour of the administrators. Furthermore, the court dismissed the City of Amsterdam’s demand that the administrators enter into negotiations with the City of Amsterdam about the future of the hospital building.
