Aaldert ten Veen joins the Dutch Council of State

Aaldert ten Veen, partner and former board member of Stibbe, was today nominated by the Dutch government to be appointed to the Administrative Law Division of the Council of State. This appointment will take effect on 1 March 2019.

Aaldert ten Veen started his career at Stibbe in 1992 and has specialised in environmental law for the past 27 years. He has been involved in leading projects in the fields of infrastructure, housing and energy for a wide variety of clients. In 2012 he joined the Stibbe board where he became heavily involved in the design of and relocation to the new office building, which was completed in 2016. At the Council of State, Aaldert will once again deal with environmental law issues.

Minister voor Rechtsbescherming bevestigt: De Awb kent twee vormen van preventieve handhaving

Short Reads - Op 21 juni 2019 heeft de Minister voor Rechtsbescherming (de "Minister") een aantal Kamervragen beantwoord over preventieve handhaving in het bestuursrecht. Deze Kamervragen gaan over twee vormen van preventieve handhaving: (i) handhaven wanneer een overtreding dreigt en (ii) handhaven wanneer een herhaling dreigt van een eerdere overtreding. Voor het toestaan van de eerste vorm van handhaving hanteren rechters een strengere maatstaf dan voor de tweede vorm.

EU Single-Use Plastics Directive is now in force: brief recap

Articles - Plastic is a significant and growing global concern. A recent study commissioned by WWF and carried out by the University of Newcastle, Australia, suggests that people are consuming around 2,000 tiny pieces of plastic every week (which is approximately 5 grams of plastic, the weight of a credit card).  In this context, the EU adopted a new directive aiming at tackling marine litter generated from 10 single-use plastic products and from abandoned fishing gear and oxo-degradable plastics. This is called the Single-Use Plastics Directive and has entered into force this month, on 2 July 2019.

ICO to impose record-breaking fines for inadequate security measures and data breaches

Short Reads - Though the European data protection authorities have taken their time in enforcing the GDPR, two announcements by the ICO in the UK regarding proposed fines for British Airways and Marriott demonstrate that large fines are about to start landing regularly. Both of the substantial fines are to be handed out as a result of shortcomings in handling data breaches caused by cyber-attacks.
