As of 1 January 2018 listed companies must apply IFRS 9 (Financial Instruments), which replaces IAS 39, in their consolidated annual accounts. On 10 November 2016 ESMA published a public statement (including an accompanying press release) on IFRS 9. Among other things, ESMA calls on listed companies to start implementing IFRS 9 as soon as possible in light of the need for consistent and high-quality implementation of IFRS 9.

ESMA furthermore highlights that listed companies should be transparent towards investors on the impact of IFRS 9 on the financial position and the financial performance of the company. ESMA reaffirms the need for consistent and high-quality implementation of IFRS 9 and the need for transparency on its impact to users of financial statements.

Entry into force of the RBE Regulation and update

Articles - The Grand-Ducal Regulation of 15 February 2019 on the registration, payment of administrative fees and access to information recorded in the register of beneficial owners (the “RBE Regulation”) entered into force on 1 March 2019 and depicts the practical aspects of the Law of 13 January 2019 establishing a beneficial owner register (the “RBE Law”). Another document, the LBR Circular 19/01 (the “Circular”) issued by the Luxembourg Business Registers on 25 February 2019  further describes the new register of beneficial owners (the “RBE”) with the aim of helping users.
