Stibbe represented an upmarket department store company in the highly publicized proceedings before Belgium’s Supreme Court (Hof van Cassatie/Cour de cassation) regarding the validity of the national sales period legislation in light of EU law.

We helped the retail company obtain a declaration that Belgian consumer legislation on sales period advertisement restrictions were not compliant with the European Unfair Trade Practices Directive. This case resulted in several public announcements issued by the Minister in charge of Economic Affairs. The ruling impacted Belgian trade practices law and the parliamentary review of trade practices regulation.
