On 1 September 2017, the European Securities and Markets Authority (“ESMA”) released the seventh version of its questions and answers (the “Q&A”) on the Market Abuse Regulation (No. 596/2014) (“MAR”).

ESMA’s updates to the Q&A address the categories of firms obliged to detect and report market abuse under Article 16(2) of MAR, the types of financial instruments falling within the market sounding regime outlined in Article 11 of MAR, the persons obliged to draw up, update and file insider lists under Article 18(1) of MAR, and when issuers remain fully responsible for compliance with the insider list requirements under the second paragraph of Article 18(2) of MAR.
