On 7 December, lawyers Anna Collignon (administrative law) and Marleen Velthuis (criminal law) will give a lecture at the University of Amsterdam (UvA) about the possible enforcement action that companies could face under environmental law. They will  focus on the area where administrative supervision turns into a criminal investigation and provide insight into the different rules and obligations for each stage of the investigation.

In addition to the possible sanctions, Anna and Marleen will give practical guidance on the dos & don'ts  with a view to avoiding enforcement action as far as possible. There will also be ample opportunity for questions and discussion. 

Background

Due to the multitude of statutory rules in the field of  environmental law, companies are often faced with inspections and subsequent sanctions for alleged infringement.   From a company's perspective, the line between administrative and criminal enforcement is becoming blurred. Inspectors of the Inspectorate of Social Affairs and Employment (ISZW), the Human Environment and Transport Inspectorate (ILT) or environmental services are often both supervisor (administrative) and investigating officer (criminal). For that reason, it's not always clear for companies which requirements apply and how they should cooperate. However, it is essential for companies to know the difference between the rules and penalties that apply from an administrative law and criminal law perspective.

De Codextrein: hoe zit dat nu? Een stand van zaken

Articles - De Codextrein nadert het eindstation met (opnieuw) enkele extra wagonnetjes. Over de eerste reeks van extra amendementen werd het advies van de afdeling Wetgeving van de Raad van State ingewonnen. Dit alles had vandaag moeten worden besproken in de bevoegde Commissie van het Vlaams Parlement. Gelet op het laattijdig ontvangen van een tweede reeks van nieuwe amendementen (ter antwoord op de bezorgdheden van de afdeling Wetgeving van de Raad van State), werd de behandeling in de Commissie met één week uitgesteld.
