We advise on many domestic and international matters including bankruptcy and judicial reorganisation, enforcement of (un)secured rights, debt rescheduling, workouts, risk assessing, bond restructurings and dispute resolution. We have also acted as administrator in some of the highest-profile bankruptcies in recent years.

Short Reads - Het Wetsvoorstel Wet Homologatie onderhands akkoord (“WHOA”) is op 26 mei 2020 door de Tweede Kamer aangenomen en is momenteel in behandeling bij de Eerste Kamer. De WHOA combineert aspecten van de Engelse Scheme of Arrangement en de Amerikaanse Chapter 11 procedure. Ondernemingen die in zwaar weer verkeren krijgen de mogelijkheid om hun schulden buiten formele insolventieprocedures te herstructureren door een akkoord op te leggen aan (een deel van) de schuldeisers. De verwachting is dat de wet dit najaar in werking zal treden.

Verifieerbare vorderingen, de stand van zaken na Credit Suisse/Jongepier q.q.

Articles - De afgelopen jaren heeft de Hoge Raad verschillende arresten gewezen over de invloed van het faillissement op wederkerige overeenkomsten, het fixatiebeginsel en de kwalificatie van vorderingen als boedelvordering, verifieerbare vordering of nietverifieerbare vordering. In het arrest van 23 maart 2018 (hierna: Credit Suisse/Jongepier q.q.) verduidelijkt de Hoge Raad ter beantwoording van enkele prejudiciële vragen wanneer vorderingen die voortvloeien uit een ten tijde van het faillissement reeds bestaande rechtsverhouding voor verificatie in aanmerking komen.
