Mede in het kader van zijn promotieonderzoek aan de Universiteit Leiden legt Ali al Khatib in dit artikel uit hoe de Europese rechter oordeelt over staatssteun aan DAEB’s als het openbaar vervoer, sociale huurwoningen en publieke omroepen. Hij constateert dat de Europese Commissie bij sommige diensten, bijvoorbeeld de bouw van sociale huurwoningen, wellicht té streng aan het staatssteunrecht toetst en dus meer ruimte zou kunnen bieden aan nationale overheden om sociale huurwoningen voor onder meer de middenklasse te helpen financieren.

Dominant firm may refuse to supply retailer after initial delivery

Articles - The Brussels Court of Appeal has held that a dominant producer firm may have valid reasons to refuse further supplies to a retailer, despite its dominance and despite previous deliveries. The Court of Appeal stressed the freedom for any company, including dominant firms, to choose their trading partners, in particular when there are valid and objective non-discriminatory reasons to refuse further direct supplies and when the retailer has alternative sources of supply.

Mobility as a Service (“MaaS”) in bestemmingsplannen. Hoe werkt dat?

Short Reads - Op 29 oktober 2021 (ECLI:NL:RVS:2021:2403) schorste de voorzieningenrechter van de Afdeling bestuursrechtspraak van de Raad van State een bestemmingsplan omdat de ontwikkeling die het plan mogelijk maakt onvoldoende voorziet in de parkeerbehoefte op eigen terrein, aangezien deelname aan MaaS uiteindelijk is gebaseerd op vrijwilligheid. Deze uitspraak is aanleiding voor dit blogbericht om te bezien hoe MaaS-oplossingen, als onderdeel van duurzame mobiliteit, wel in bestemmingsplannen kunnen worden geregeld.
