On 17 May, Stibbe will host a Masterclass for the members of Nederlands Genootschap van Bedrijfsjuristen (NGB), the Dutch association of general counsels,  about administrative supervision.  Anna Collignon, Rein Wesseling, Muriël Rosing and Tom Barkhuysen from Stibbe will discuss the relevant supervisory issues from various legal perspectives.

Administrative supervisors and enforcement authorities

At some point, companies will be confronted with administrative supervisors and enforcement authorities such as the Dutch Data Protection Authority, the Netherlands Authority for the Financial Markets or the Human Environment and Transport Inspectorate. In these circumstances, what should  companies do? What is the legal position of the company? What do the authorities expect from companies? How can companies maintain a working relationship with the supervisors? During the Masterclass, the four lawyers from Stibbe will answer such questions and provide tips and tricks to prevent problems with the authorities and on what to do when something goes wrong and the authority decides to take action. The Masterclass will end with an interactive case study in which all topics  are brought together.

Can the government refrain from imposing enforcement measures if it is not within the offender’s power to comply with a standard?

Short Reads - What should be done if a stakeholder makes a request to the government for enforcement to rectify violations in a scenario where the offender does not have full power to comply because of a reliance on third parties? The Administrative Division of the Dutch Council of State ruled on 23 January 2019 that an administrative body cannot simply reject an enforcement request in such a situation, but must consider whether, for example, the imposition of an order subject to a penalty payment may provide an incentive for the actual termination of the violation.
