Stibbe, in close collaboration with German law firm Luther, successfully represented E.ON, and more particularly its subsidiary PreussenElektra GmbH, in an ICC arbitration against Electrabel, which passed on Belgian nuclear power tax to E.ON which in its turn passed on German Kernbrennstoffsteuer tax to Electrabel based on the drawing rights agreements concluded in the framework of the 2008 SWAP transaction between the two energy groups.

The arbitration tribunal held that PreussenElektra was not obliged to pay EUR 321 million to Electrabel as its pro rata share of the Belgian nuclear tax.
