Our Competition law and TMT teams have the pleasure of inviting you to a seminar on Innovative Partnerships, which will take place at our offices on 24 November 2017.

The digitizing economy pushes enterprises to create synergies and invest in innovative partnerships with competent and specialized service providers, allowing them to focus on their core business. Efficient partnerships require clear and sustainable contractual arrangements. Also, partnerships may involve the leveraging of significant market powers.

In this session, we will focus on key contractual terms inter alia on protecting your IP, know-how and other intangible assets, the rights to data, respective liabilities etc. We will also focus on arrangements that could be sensitive from a competition law perspective and workable solutions.

Our teams will share our best practices and discuss their insights with you. This seminar will be moderated by Hendrik Viaene, head of our Competition Law practice and by Erik Valgaeren, head of the TMT practice. Introductory presentations to the topic will be given by Delphine Gillet, senior associate in the Competition Law practice and Carolien Michielsen, junior associate in the TMT practice.

To ensure that the debate will be conducted most effectively, we inform you that attendance is limited to one person per company.

This expert meeting will take place at our offices in Brussels on the 24th of November 2017, from 12:00pm tot 2:00pm.

General Data Protection Regulation comes into effect

Short Reads - On 25 May 2018, the European Union's General Data Protection Regulation (GDPR) came into effect. The GDPR replaces the EU's prior directive governing the processing and transfer of personal data, which was in place since 1995. As a regulation, the GDPR is directly applicable in all 28 EU member states and thus removes the need for national implementing legislation. However, the GDPR allows member states discretion in certain areas, as a result of which national legislation may still be implemented. In the Netherlands, the GDPR Implementation Act came into effect on 25 May 2018.

ECJ: Facebook fan page administrator is a joint data controller

Short Reads - On 5 June 2018, the European Court of Justice ("ECJ") decided on several preliminary questions that were raised in an administrative proceeding between the German Data Protection Authority ("GDPA") and Wirtschaftsakademie Schleswig-Holstein GmbH ("Wirtschaftsakademie"), a German educational services provider that offers its services through a Facebook fan page. In its decision, the ECJ held, among other things, that Wirtschaftsakademie qualifies as a data controller ex Article 2 under d Directive 95/46/EC[1] ("Privacy Directive").

Belgian Court of Cassation annuls decision prohibiting pharmacists from using Google Adwords

Short Reads - On 7 June 2018, the Belgian Court of Cassation, ruled that a decision of the Pharmacists Association Appeals Council (Appeals Council) prohibiting pharmacists from using Google Adwords to offer over-the-counter (OTC) products violated Belgian competition law because the Appeals Council did not sufficiently justify why such a prohibition was necessary for health reasons. The Appeals Council must now issue a new decision.

Legislative proposal to protect trade secrets: update

Short Reads - On 5 July 2016, the EU Trade Secrets Directive came into effect (Directive 2016/943/EU). The directive intends to harmonise rules regarding the protection of undisclosed know-how and business information (trade secrets) across all EU member states. As the directive is not directly applicable in the member states, each member state must enact national implementing legislation.

Court of Appeal in the Netherlands decides to appoint independent economic experts in TenneT v ABB

Short Reads - On 20 July 2018, the Court of Appeal of Gelderland published another interim judgment in the ongoing proceedings between TenneT, the grid operator in the Netherlands, and ABB in relation to the gas insulated switchgear (GIS) infringement. After the Dutch Supreme Court had confirmed in a judgment of 8 July 2016 [see our August 2016 Newsletter] that the passing-on defence is available under Dutch law, the Court of Appeal of Gelderland decided to appoint independent economic experts to provide input on the calculation of overcharge and the existence of pass-on.
