In verreweg de meeste zaken in de praktijk van het ondernemingsstrafrecht is de verdenking (ook) valsheid in geschrift als bedoeld in artikel 225 Sr. De dagelijkse discussie gaat over vermoedelijk valse overeenkomsten en valse facturen, maar ook over opgemaakte rapporten en formulieren waarin mogelijk onjuistheden zouden zijn opgenomen.

In een column voor het Tijdschrift Bijzonder Strafrecht laat Marleen Velthuis aan de hand van een specifieke zaak zien dat sneller sprake is van strafrechtelijk laakbare valsheid in geschrift dan de meeste mensen zich realiseren, maar dat deze aansprakelijk niet onbegrensd is.

Short Reads - The Implementation Decree for the Wwft 2018 has been amended. As a result, as of 18 October 2019 institutions subject to the Dutch Anti-Money Laundering and Anti-Terrorism Financing Act will no longer have to report transactions solely on the basis that this transaction relates to an individual residing, or a legal entity having its registered office in, a high-risk third country.
