W&I insurance has been around for many years, but it has become increasingly popular in the last few years. According to Lockton, “recent statistics suggest that over 50% of corporate real estate transactions in Europe now use W&I insurance, a large driver for this has been the adoption of a EUR 1 cap on sellers’ liability under the SPA.”

Third country bids in EU procurement: always excluded?

Articles - The European Commission recently issued guidance on the participation of third country bidders in public procurement. It clarified bids may be excluded, but remains silent on whether they may be accepted and under which conditions. The Commission is of the opinion that contracting authorities or entities can exclude bids if no access is secured. However, it does not discuss if and under which conditions contracting authorities or entities can allow foreign bids if no access is secured.

Les nouveaux seuils européens des marchés publics à partir du 1er janvier 2020

Articles - Les règlements qui modifient les seuils européens d'application pour les procédures de passation des marchés et des concessions  sont publiés dans le Journal officiel européen du 31 octobre 2019 (JO L 279 du 31 octobre 2019). Ces modifications entraînent pour la première fois une baisse des seuils depuis 2010, tant pour les travaux que pour les fournitures et services, quel que soit le secteur. Les nouveaux seuils s'appliquent à compter du 1er janvier 2020 et sont, comme d'habitude, fixés pour une période de deux ans. Ils sont valables jusqu'au 31 décembre 2021.
