In dit artikel worden diverse procesrechtelijke complicaties besproken die het optreden in rechte krachtens materiële en formele procespartijen met zich brengen. 

Het onderscheid tussen materiële en formele procespartijen is niet als zodanig in de wet terug te vinden, maar het kan wel belangrijke implicaties hebben. Het roept onder andere vragen op met betrekking tot de ontvankelijkheid in de procedure,de bindingen ten uitvoer legging van het vonnis en het instellen van rechtsmiddelen tegen een vonnis.
