Stibbe has established an expert group on emissions trading that provides high-level advice on tax, administrative, civil and commercial aspects of emissions trading. Our lawyers regularly contribute to seminars and ministerial working groups with regard to emissions trading.

While the trade in emission rights is considered to be an efficient way to achieve the Kyoto targets, it has a huge impact on the companies involved. We are able to provide these companies with innovative advice on their legal and administrative obligations arising from emissions trading regulations.

Stibbe is one of the leading advisors in the trade in emission rights. We have acted as counsel to various clients in their successful appeals against the Allocation Decision of the Dutch government and are advising a large number of clients including Air Liquide, Yara, EPZ and Elsta on the allocation of emission rights. We further advise various companies on Clean Development Mechanism and Joint Implementation projects and on their contact with the Dutch emissions authority.
