European Commission opens three investigations in the e-commerce sector

Short Reads - On 2 February 2017, the European Commission published a press release announcing that it had launched three separate investigations in the e-commerce sector (two investigations on its own initiative and one following complaints from customers). These investigations are part of the Commission’s broader Digital Single Market Strategy, which aims to eliminate barriers that hinder cross-border online sales [see our October 2016 Newsletter].

General Court dismissed action by Uralita in the Sodium Chlorate cartel

Articles - On 6 October 2015, the General Court ("GC") dismissed an application brought by Corporación Empresarial de Materiales de Construcción (formerly known as "Uralita") for annulment of a Commission Decision in the Sodium Chlorate cartel. The GC rejected Uralita's claim that the Commission did not adhere to the applicable time-limits. More specifically, the GC found that the Commission's decision to grant conditional immunity to an undertaking constitutes an act that will interrupt the five-year limitation period in Article 25(1) Regulation 1/2003 for all cartel participants.

Court of Justice confirmed that cartel facilitators can be liable under Article 101 TFEU in AC-Treuhand

Articles - On 22 October 2015, the Court of Justice rendered a judgment on appeal against the Commission decision in the Heat Stabilisers cartels (Commission v AC-Treuhand AG C-194/14 P). In this landmark judgment, the Court of Justice confirmed that a fine can be imposed under Article 101 TFEU on a consulting firm that provided services to the cartelists but is not present on the market where the infringements were committed.
