Hendrik Viaene

Hendrik focuses on European and Belgian competition law (merger control, cartels and abuse of dominant position), state aid and free movement of goods, services, persons and capital. 

With regards to European law, Hendrik represents clients before national courts, administrative authorities, the Court of Justice and the European Commission. He also assists clients on compliance matters with European sanction regimes and international trade issues.

Furthermore, Hendrik advises on Belgian competition law and assists clients in structuring acquisitions, joint ventures and agreements. He also represents clients in complaints & requests for interim measures and merger notifications before the Belgian Competition Authority and the Court of Appeals in Brussels.

Hendrik has a Master of Laws in European Law (LL.M) from King’s College University London.

Commercial Court of Ghent grants compensation to parallel importers for competition law infringement by Honda

Short Reads - On 23 March 2017, the Commercial Court of Ghent ruled that the damages claim brought by parallel importers in the Honda motorcycle abuse of dominance case were not time-barred. In March 1999, following a complaint filed by a number of parallel importers, the Belgian Competition Authority (BCA) imposed a fine of approximately EUR 750,000 on Honda Motor Europe Logistics for abusing its dominant position on the Belgian market for the issuance of conformity certificates for Honda motorcycles.

General Court annuls European Commission's merger blocking decision in UPS/TNT for procedural errors
