Stibbe represented the bankruptcy trustees of  the Amsterdam hospital MC Slotervaart in proceedings against the City of Amsterdam, centred on the City’s demand that the bankruptcy trustees investigate whether there were any irregularities prior to the bankruptcy.

The bankruptcy trustees claimed that such an investigation is neither required nor appropriate as MC Slotervaart has offered a plan of composition to its creditors, with financing fromreal estate company Zadelhoff, under which it will pay 100% to its creditors. This plan would be endangered by lengthy investigations. In its 10 July 2019 judgment, the Amsterdam District Court ruled in favour of the bankruptcy trustees. Furthermore, the court dismissed the City of Amsterdam’s demand that the bankruptcy trustees enter into negotiations with the City of Amsterdam about the future of the hospital building.
