In both Belgium (Cour de cassation/ Hof van Cassatie) and the Netherlands (Hoge Raad der Nederlanden), we have a very strong track record of assisting our clients.

Working as a coordinated team, our lawyers actively share knowledge and experience to enhance each client’s case. This approach is applied to all key services and enables us to advise on the chances of success of an appeal before the Supreme Court, drafting and filing statements of defence, and appearing before the Supreme Court on behalf of our clients.

Damage due to a defective driveway and the Dutch twenty year limitation period: When does limitation start in case of a continuous event that causes damage?

Short Reads - On 22 March 2019, the Dutch Supreme Court ruled (ECLI:NL:HR:2019:412) that the strict liability for buildings (opstalaansprakelijkheid) is not linked to a specific damaging act but to a damaging condition, as referred to in section 6:174 DCC. Therefore, there is no reason to regard a damaging act as an 'event that caused damage' as referred to in section 3:310 DCC concerning the limitation period for claims for damages.

Hof van Cassatie trekt streep door eerste schadevergoeding toegekend door Raad van State

Articles - Opdat aan de Raad van State een ontvankelijk verzoek tot schadevergoeding zou kunnen worden gericht, is onder meer vereist dat er een arrest voorligt waarin de Raad van State de onwettigheid van een handeling vaststelt. Het Hof van Cassatie verduidelijkt in een arrest van 15 september 2017 wat moet worden begrepen als een "arrest waarbij de onwettigheid wordt vastgesteld". Een arrest dat de intrekking vaststelt, valt er volgens het Hof niet onder.
